  • Account information: Name, email, organization, and role when you create an account.
  • Payment information: Billing details processed by our third-party payment processor. We do not store credit card numbers.
  • Content and data: Agent configurations, policies, prompts, documents, and other content you submit to the platform.

Information Collected Automatically

  • Usage data: Pages visited, features used, timestamps, and interaction patterns.
  • Device information: Browser type, operating system, IP address, and device identifiers.
  • Log data: Server logs, error reports, and performance metrics.

2. How We Use Your Information

  • Provide, operate, and maintain the Services.
  • Respond to your inquiries and provide customer support.
  • Send transactional communications related to your account or use of the Services.

3. AI Data Processing

Record routes agent actions through third-party AI model providers (such as OpenAI, Anthropic, Google, and others selected by you or your organization) as part of the Services. When you use AI-powered features:

  • Prompts, tool calls, and related context may be transmitted to the AI model provider you have configured.
  • Each provider processes data according to its own terms and privacy policy.
  • We do not use your data to train AI models. Your content is never used to train, fine-tune, or improve any foundation model.
  • We maintain a list of AI sub-processors, available upon request.

4. How We Share Your Information

We do not sell your personal information. We share information only in the following circumstances:

  • Service providers: Third-party vendors who assist in operating the Services (hosting, email delivery, analytics, payment processing, AI model providers). Each is bound by data processing agreements.
  • Legal requirements: When required by law, subpoena, court order, or government regulation, or when we believe disclosure is necessary to protect our rights, your safety, or the safety of others.
  • Business transfers: In connection with a merger, acquisition, bankruptcy, or sale of all or a portion of our assets, your information may be transferred as part of that transaction.
  • With your consent: When you direct us to share information with a third party.

5. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this policy, unless a longer retention period is required by law. Contact form submissions are retained for the duration of our business relationship plus three (3) years. You may request deletion at any time.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

European Economic Area, UK, and Switzerland (GDPR)

If you are located in the EEA, UK, or Switzerland, our legal basis for processing your personal information depends on the context: legitimate interest for B2B communications and service delivery, contract performance for account holders, and consent where applicable. You have the right to access, rectify, erase, restrict processing, data portability, and object to processing. You may also lodge a complaint with your local supervisory authority.

For enterprise customers, Record acts as a data processor under GDPR. A Data Processing Agreement (DPA) is available upon request.

Other US States

8. International Data Transfers

Your information may be transferred to and processed in the United States. For transfers from the EEA, UK, or Switzerland, we rely on Standard Contractual Clauses (SCCs) approved by the European Commission or other appropriate transfer mechanisms.

The Services are not intended for children under 16. We do not knowingly collect personal information from children under 16.
